TERMS AND CONDITIONS - BACK TO EMPATHY

 

DEFINITIONS

Back to Empathy: Individual company owned by Elena Bernasconi Tabellini, inclusive of all individuals working for Back to Empathy (e.g., an assistant). For clarity, Back to Empathy is referred to as 'we', 'our', and 'us'.

Client: The individual or organization (e.g., an employer) assigning tasks to Back to Empathy. For clarity, the client is addressed as 'you' and 'your'.

Participant: The individual participating in a session, practice group, workshop, course, etc., who did not initiate the assignment themselves (e.g., an employee).

Session: All services scheduled by appointment, such as coaching, 1-on-1 counseling, private empathy sessions, or mediation.

Workshop: All services allowing multiple participants and taking one day or less, including introductory workshops and practice groups.

 

1. APPLICATION

These general terms and conditions apply to all agreements between Back to Empathy and the Client and/or Participant.

2. NATURE OF THE SERVICE

All our services are commitments to effort. Our service aims to enhance connection, compassion, and insight. We cannot guarantee finding specific strategies to fullfil your needs.

3. INFORMATION PROVIDING

You must provide us with all information necessary for the proper execution of the assignment, such as medication use, previous (psychological) treatments, and/or diagnoses.

4. LIABILITY

We assume that you are capable of self-care. In cases of serious psychological issues, we advise consulting a doctor or psychologist. You are responsible for your choices and behavior, both during and after our service.

We are not liable for direct or indirect damage, emotional harm, or consequences resulting from your decisions. Damage caused to property or possessions of ours, third parties providing locations or materials, or other participants may be recoverable from you.

5. PRIVACY & CONFIDENTIAL INFORMATION

During sessions: All discussions during sessions are treated confidentially.

During group activities: Confidentiality must be maintained when participating in group activities.

Dealing with confidential information: Confidential information is never shared with third parties unless explicit permission is given.

6. PAYMENT

Payment is due before a session, workshop, or course to secure your place.

Payment methods: Credit card or Paypal. Invoices are automatically generated.

Delayed payments: Costs of collection will be charged to the client for delayed payments.

7, CANCELLATION POLICY

  1. Cancellation by Participant:

    • If you wish to cancel your participation in a coaching or workshop, please notify us via email at least 1 week before the scheduled start date for workshops and 24 hours before the scheduled start date for coaching sessions.

    • Cancellations made after this terms may incur a cancellation fee of 40% for workshops and 100% for coaching. 

    • Cancellations made after the commencement of the workshop or failure to attend without prior notification may result in the full workshop fee being charged.

  2. Cancellation by Organizer:

    • We reserve the right to cancel or reschedule a coaching workshop due to unforeseen circumstances or if the minimum number of participants required for the workshop is not met.

    • In such cases, participants will be notified as soon as possible and offered the choice of a full refund or the option to transfer their booking to a future workshop.

  3. Refunds:

    • Refunds for cancellations, when applicable, will be processed within 7 days from the date of cancellation.

    • Refunds will be issued using the original payment method.

  4. Exceptions:

    • In exceptional cases, such as documented emergencies or unforeseen circumstances, we may consider waiving the cancellation fee upon receipt of adequate supporting documentation.

    • Requests for exceptions to the cancellation policy will be reviewed on a case-by-case basis.

  5. Modification of Terms:

    • These cancellation terms and conditions are subject to change at our discretion. Any modifications will be communicated to participants via email or through our official communication channels.

By registering for a coaching workshop, you agree to abide by the above-stated cancellation policy.

8. COPYRIGHT

The copyright for all materials belongs to the author, Back to Empathy, Elena Bernasconi-Tabellini. Ownership of course materials rests with Back to Empathy.

9. COMPLAINTS

If you're dissatisfied with any of our services, please report it within 14 days via email to info@backtoempathy.com.

The owner and founder of Back to Empathy, will respond within 14 days. Utilizing Nonviolent Communication, I'll identify the needs and work towards a solution.

If a resolution cannot be reached, an impartial third party, a Nonviolent Communication Mediator, will be invited to arbitrate the conflict with a binding decision.

Complaints will be fully addressed within 30 days and handled confidentially.

13. INDEMNIFICATION

Third parties cannot derive any rights from the services of Back to Empathy.
