Welcome to Back To Empathy. These Terms & Conditions govern your use of our website www.backtoempathy.com and participation in any of our programs, courses, coaching, or other services (collectively, the "Services"). By using this website or purchasing any Services, you agree to these Terms & Conditions.
1. Ownership & Use of Content
All content on this website, including but not limited to texts, scripts, course materials, videos, downloads, and tools, is the intellectual property of Elena Bernasconi-Tabellini and Back To Empathy unless otherwise stated. You may not share, copy, distribute, modify, or reproduce any materials without prior written permission.
You may use the materials solely for your personal, non-commercial use within the scope of the course or service you purchased.
2. Services Access
Access to digital courses, coaching sessions, and downloadable resources is limited to the individual/couple who purchased the program. Group access, sharing, or transferring login details is not permitted.
Live group coaching sessions may be recorded and made available to other enrolled participants. These recordings are meant to support learning and allow those who miss live sessions to stay updated with the group’s progress. If you prefer not to be recorded, you may participate via chat and keep your audio/video off.
3. Use of Recordings and Testimonials
Indvidual/Couple/Group coaching recordings will never be used for marketing purposes without your prior written consent. If you share a testimonial (written, audio, or video), you grant permission to use it for promotional or educational purposes unless otherwise agreed.
4. Services Disclaimer
Back To Empathy offers educational and coaching-based Services. These are not a substitute for psychotherapy, mental health treatment, or medical advice. If you require such services, please consult a qualified professional.
Our programs provide practical tools to increase connection, calm, and empathic leadership in parenting and professional life, but do not diagnose or treat any condition. Results depend on the active commitment of participants.
Couple coaching is not psychotherapy, counseling, or legal mediation. It does not replace medical, psychiatric, or therapeutic treatment. Results depend on the active commitment of both partners. The process is intended to provide strategies, tools, and a supportive space to address recurring patterns and improve communication, not to provide medical or legal solutions.
5. Confidentiality
Back to Empathy is committed to providing a safe and respectful space for all clients and participants. All information shared during coaching sessions, group programs, online courses, or retreats is treated as strictly confidential and will not be disclosed to third parties without the client’s written consent, except where disclosure is required by law or where there is a risk of harm to self or others.
In group settings (courses, programs, or retreats), participants are expected to respect the confidentiality of others and not share personal information outside the group.
In couple coaching, confidentiality applies to the process as a whole. Information shared in individual sessions may not automatically remain private from the other partner, unless explicitly agreed at the start of the process. The purpose of individual sessions within couple coaching is to support the joint process and to work on the real issues in a constructive way, not to withhold information from one another.
Back to Empathy may use feedback or testimonials for learning and promotional purposes, but always and only with the client’s explicit consent. Testimonials may be published with the client’s first name (or initials) and context, if the client has agreed in writing.
6. Your Responsibility & Assumption of Risk
By enrolling in any course, attending coaching, or using this website or our Services, you acknowledge and accept full responsibility for how you apply the information provided. You agree to use your judgment and understand that results are not guaranteed.
Damage to property: In the case of in-person events, participants may be held responsible for any damage caused to venues, third-party equipment, or shared materials due to negligence or inappropriate behavior.
You accept all risks associated with your participation and release Back To Empathy from any liability arising from your actions or interpretations.
7. Refund & Cancellation Policy
We truly care about your satisfaction. If something didn’t meet your expectations, we encourage you to write to us at elena@backtoempathy.com and share your concerns. We’ll always try to find a fair and human solution.
Due to the nature of digital content and group programs with limited seats, refunds are not automatically guaranteed and are considered on a case-by-case basis. Specific cancellation policies apply depending on the type of service:
Flagship Programs (e.g., The Stress-Free and Shame-Free Parenting Program™): A 30-day money-back guarantee applies, provided you meet the minimum engagement criteria outlined at the time of purchase.
Workshops, Group Courses, and Retreats: Each of these services may have different cancellation and refund policies, which are clearly communicated during the booking or registration process. Please refer to the specific event or course description for applicable terms.
Individual and Couple Coaching Sessions: Please notify us at least 24 hours in advance to avoid a full charge. Sessions canceled with at least 24 hours’ notice may be rescheduled without charge. Sessions canceled with less than 24 hours’ notice are charged in full (or not reimbursed, if already paid). All coaching packages have a defined validity period starting from the first session. Clients are responsible for scheduling their sessions within the validity period. Unused hours after this period are non-refundable.
Empathic Coaching in Nature: This service is provided locally and follows its own cancellation and rescheduling policy, which is outlined at the time of booking. Please contact us directly if you have any doubts.
Cancellation by Organizer: We reserve the right to cancel or reschedule a coaching session, course, or event due to unforeseen circumstances or insufficient participant numbers. In such cases, participants will be notified promptly and offered either a full refund or the option to transfer their booking to a future date.
Refunds, when applicable, will be processed within 7 days using the original payment method. In exceptional cases (e.g., documented emergencies), we may waive cancellation fees. These terms may be updated at our discretion.
8. Payments & Installments
Payments for courses, coaching, or digital products must be completed via our secure payment platforms. If you select an installment plan, you are responsible for completing all scheduled payments unless otherwise agreed.
Payment for coaching packages are due in advance. Once a package has begun, refunds are not possible, except in exceptional circumstances at the discretion of Back to Empathy. Sessions included in packages cannot be transferred to third parties. In the case of package purchases, sessions must be scheduled within 6 months of purchase and unused hours are non-refundable .
Depending on the offer, programs and coaching packages can be paid either in full or in installments, as agreed before the start of the programs/sessions.
Failure to complete payments may result in revoked access to the program. In case of payment issues, we invite you to contact us so we can find a respectful solution together.
Clients who purchase Packages and later choose to upgrade to a larger package may do so by paying only the difference in price. Sessions already completed will be counted toward the upgraded package, and the lower hourly rate of the larger package will apply.
9. Sharing & Fair Use
You may not share, resell, or redistribute any content or Services purchased from Back To Empathy. You may link to our publicly available pages for personal or professional purposes, as long as you give clear credit and do not present the content as your own.
For commercial collaborations, written permission is required.
10. Indemnification & Limitation of Liability
You agree to indemnify and hold harmless Back To Empathy, Elena Bernasconi, and any affiliates from any claims, damages, or losses arising out of your use of this website or Services.
We do not make any guarantees regarding outcomes, and our liability is limited to the fees paid by you for the Services.
11. Errors & Omissions
We make every effort to provide up-to-date, accurate information across our website and Services.. However, we are not responsible for unintentional errors or omissions. You are encouraged to use your judgment and consult other sources when appropriate.
12. Collaborators
Unless otherwise specified, all services are provided by Elena Bernasconi or qualified internal and external collaborators acting on behalf of Back To Empathy. While we make every effort to work with collaborators who share our values and professionalism, we are not liable for errors, omissions, or actions of collaborators acting in their own capacity or outside the agreed scope of delivery.
13. Termination
We reserve the right to terminate your access to a program or service without refund in cases of inappropriate behavior, abuse, or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. In case of a dispute, we encourage friendly resolution. If not possible, jurisdiction lies with the courts of the canton of Ticino, Switzerland.
15. Entire Agreement
These Terms & Conditions, together with our Privacy Policy, represent the full agreement between you and Back To Empathy. Any changes or exceptions must be made in writing and agreed by both parties.
Back To Empathy reserves the right to modify these Terms & Conditions at any time. Any updates will be posted on this page with a revised "Last updated" date. Continued use of the website or services after such changes implies acceptance of the revised terms.
