By joining the Back To Empathy Affiliate Program, you (“Affiliate”) agree to the following terms and conditions with Back To Empathy – Elena Bernasconi (“Provider”), Certified Trainer in Empathic Communication & Coach.

1. Purpose

These terms define the collaboration between the Provider and the Affiliate for promoting:

• The free online masterclass “5 Easy Ways to Stop Yelling and Start Connecting with Your Child™”, and

• The paid program "The Stress-Free & Shame-Free Parenting Program™".

The Affiliate may share the Provider’s invitations and materials within their own online or offline communities (e.g., WhatsApp, Facebook, or other groups).

2. Provider’s Definition

For the purpose of this agreement, the term “Provider” refers to Back To Empathy, owned and operated by Elena Bernasconi-Tabellini, who acts as the sole representative and decision-maker regarding affiliate approvals, payments, and communications.
Participation in the affiliate program becomes effective only after written confirmation or email acceptance from Elena Bernasconi-Tabellini.

3. Provider’s Responsibilities

The Provider will:

• Manage all registrations, communication, and customer support.

• Provide official promotional materials (texts, visuals, links).

• Supply a unique affiliate link or coupon code for tracking sales.

• Inform the Affiliate of total confirmed sales at the end of each campaign.

• Calculate commissions on confirmed (non-refunded) sales and pay them 40 days after each purchase by bank transfer only.

4. Affiliate’s Responsibilities

The Affiliate agrees to:

• Share official materials only within their relevant communities.

• Not modify or shorten official texts, links, or program names.

• Represent the Provider’s work with professionalism and integrity.

• Not run paid ads or additional campaigns without written consent.

• Respect participant privacy and confidentiality at all times.

5. Commission and Payment

• Flat CHF 100 commission for each confirmed (non-refunded) enrolment in "The Stress-Free & Shame-Free Parenting Program™" made through the Affiliate’s unique link.

• Only valid for fully paid, non-refunded purchases.

• Commissions are paid 40 days after each purchase, by bank transfer to the Affiliate’s nominated account, to fully honor the program’s 30-day money-back guarantee and allow for processing time.

• If a refund is issued within the 30-day guarantee window, that sale becomes ineligible for commission.

• No payments via PayPal or cash.

6. Confidentiality

Both parties agree to keep confidential any shared business information, client data, or marketing materials.

7. Independent Contractor

The Affiliate acts as an independent partner. No employment, joint venture, or exclusivity is implied.

8. Duration and Termination

The collaboration starts upon registration and remains active for current and future campaigns unless terminated by either party in writing.

Either party may terminate this collaboration at any time by written notice (email is sufficient).
The Provider may terminate the agreement immediately if the Affiliate:

• Misrepresents the Provider’s work or shares inaccurate information about the programs.

• Uses unethical or misleading marketing practices.

• Fails to comply with these terms and conditions or acts in a way that could harm the Provider’s reputation.

The Affiliate may terminate the agreement at any time if they no longer wish to participate in the affiliate program.

Upon termination:

• The Affiliate will stop using the Provider’s promotional materials and links.

• Any pending commissions for eligible sales prior to termination will still be paid according to the agreed payment terms.

9. Agreement Acceptance

By ticking the checkbox on the Affiliate Program sign-up page, you confirm that you:

• Have read, understood, and agree to these terms.

• Understand that commissions are paid 40 days after each purchase to allow for the 30-day refund window.

• Understand that your participation becomes effective only after confirmation by Elena Bernasconi-Tabellini / Back To Empathy.

• Will act in accordance with Back To Empathy’s brand values of empathy, professionalism, and integrity.
